To end a month-to-month tenancy in Hawaii, the notice period is 45 days, set by HRS § 521-71(a), (b). The words: “When the tenancy is month-to-month, the landlord may terminate the rental agreement by notifying the tenant, in writing, … at least forty-five days in advance of the anticipated termination.” A tenant who wants to leave gives 28 days instead: “at least twenty-eight days in advance of the anticipated termination.”

Of the 29 states verified on this site, 25 require less notice and 3 require more, counting a month as 30 days for comparison; the median is 30 days. No other verified state uses the same length.

Worked date: a notice delivered on November 10, 2026 runs its 45 days on December 25, 2026, so the notice can name December 25, 2026 or a later date as the end of the tenancy, 45 days after delivery.

Given on the rent day itself, December 1, 2026, the same notice reaches its end on January 15, 2027, 45 days later. A period stated in days is the same length in every month.

Hawaii has no land neighbours; the closest figures in the ranking: Arizona requires 30 days, Delaware requires 60 days and Florida requires 30 days.

After the notice: the landlord then has 14 days to return the security deposit (deposit rules), so a tenancy ending on December 25, 2026 puts the deposit deadline at January 8, 2027; rent that falls due before the end date is still owed, and Hawaii's late-fee rule is 8% of the rent due (late fees).
