The rule in New York
To end a month-to-month tenancy in New York, the notice period is 30 days for a tenant in the first tier of occupancy, set by N.Y. Real Prop. Law § 226-c(2). The words: “If the tenant has occupied the unit for less than one year and does not have a lease term of at least one year … the landlord shall provide at least thirty days' notice.” The section quoted addresses the landlord's notice.
Of the 29 states verified on this site, 3 require less notice and 4 require more, counting a month as 30 days for comparison; the median is 30 days. 21 others land on the same length, among them Arizona, Florida, Idaho and Illinois.
Worked date: a notice delivered on November 10, 2026 runs its 30 days on December 10, 2026, so the notice can name December 10, 2026 or a later date as the end of the tenancy, 30 days after delivery.
Given on the rent day itself, December 1, 2026, the same notice reaches its end on December 31, 2026, 30 days later. A period stated in days is the same length in every month.
The period grows with time in the unit: 30 days at first, 60 days after 1 year and 90 days after 2 years. From the same November 10, 2026 delivery that means December 10, 2026 (30 days), January 9, 2027 (60 days) and February 8, 2027 (90 days).
Across the border, among neighbours with a verified rule: Massachusetts requires one month and Vermont requires 60 days at first.
Longer occupancy means longer notice: 60 days after one year (or a lease of one to two years) and 90 days after two years (or a lease of at least two years), per § 226-c(2). Rent-regulated apartments and other New York City rules are outside this record.
After the notice: the landlord then has 14 days to return the security deposit (deposit rules), so a tenancy ending on December 10, 2026 puts the deposit deadline at December 24, 2026; rent that falls due before the end date is still owed, and New York's late-fee rule is $50 or 5% of the monthly rent, whichever is less (late fees).

Giving or receiving notice
The statute sets the shortest period; a lease can add conditions such as a written form or a delivery method, and some cities add their own rules. The guide on ending a month-to-month tenancy compares how the verified states count the period.
